A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without lawful basis.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation stems from a mistaken removal to El Salvador in March, which the government later admitted was an error. After his return to the United States to answer alien smuggling allegations, he was held in immigration detention.

In her decision, the court pointed out that the authorities lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Context of the Case

The legal challenge center on conflicting claims. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in Tennessee.

The judge, who was hearing his challenge to removal in a federal court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
